This Agreement is between you (`customer`) and Radius Bank (“Bank”) with its main location in One Harbor Street, Suite 201, Boston, MA 02210. This agreement regulates the customer`s use of the Mobile Deposit Service (“Service”). The bank only offers the service under this contract in connection with the customer`s deposit accounts with the bank (“account”), and this agreement complements, but does not replace an agreement (s) that the customer could have performed with respect to services other than the service. 2. Hardware and software. This service requires the customer to use an Apple iPhone, Android device or BlackBerry smartphone (“mobile device”) to make a deposit and transfer the images. The customer may incur additional costs related to additional items, including, but not limited, telephone or internet service costs related to the use of the service. The customer is responsible for all costs or expenses related to compliance and maintenance of these technical requirements or additional elements necessary for the use of the service. The customer accepts that he is solely responsible for the operation and maintenance of all devices used in this Agreement and ensures that the maintenance recommended by the Seller is carried out by trained staff, whether it is the customer`s staff or third parties. The bank is not responsible for computer viruses or related problems that may be related to the use of the mobile device or the Internet to provide the service. The bank is not responsible for errors or failures due to defects or malfunctions of the customer`s hardware or software for mobile devices.
The bank advises customers to regularly scan their mobile device and software with a reliable product to detect computer viruses in order to detect and remove computer viruses. 1. Performance statement. Subject to the terms of this agreement, the bank will provide the customer with the service that allows the customer to make deposits on the customer`s account or accounts by taking a picture of the item on a mobile device. The device records an image of the front and back of the test and reads and captures the magnetic color sign detection line (“MICR”) of the test. After entering the image and data, the customer will transmit the image to the bank or processor designated by the bank (“processor”) via the device`s network connection and will temporarily credit the customer`s account for the amount of the deposit and enter the cheque images in the collection process in accordance with the terms and conditions of your account (“deposit contract”) and this agreement.
